The Mobile World Congress takes place from February 26 to February 29, 2024, in Barcelona. This congress is considered the most important in the mobile communications and telephony sector worldwide, which makes the protection of Intellectual Property especially relevant. In this edition, the Mobile World Congress is adopting a new motto: “Future First”.

Innovation and Technology: Key Themes of MWC 2024

The technologies that will be most prominent this year are 5G & Beyond (the impact it generates), Connecting Everything (how the growing phone ecosystem can work better), Humanising AI (Artificial Intelligence, growth, and impact), Manufacturing DX (Digital engineering and manufacturing), Game Changers (new technologies that will modify the future), and Our Digital DNA (Digital inclusion and sustainable technology).

In the 2023 edition, the congress had more than 88,500 attendees, 2,400 exhibitors, and representation from 202 countries and territories. This year, more than 100,000 attendees, over 2,400 exhibitors, and surpassing 200 countries and/or territories are expected.

In this upcoming edition, among the most notable participants are Amazon, Caixa Bank, Ericsson, Fujitsu, Google, Huawei, Microsoft, Netflix, Nokia, Orange, and Samsung, among others.

Legal Support for the Mobile World Congress in Intellectual Property

At ISERN Patentes and Marcas, we have created a special team to address any questions that arise in relation to Intellectual Property before, during, or after the Mobile World Congress.

This event, besides facilitating the distribution of technological inventions, can also lead to conflicts in the area of Intellectual Property rights related to the products or services presented. For this reason, the Commercial Courts of Barcelona and Alicante have welcomed a “duty service and rapid response protocol“. This protocol will be in effect throughout the month of February, including the days of the event.

Intellectual Property Protocol for the Mobile World Congress BCN (MWC 24)

The duty service and rapid response protocol of Intellectual Property includes the following areas:

  • Preferential and priority processing of applications for preliminary proceedings and/or fact-finding proceedings related to patents, technological innovations, and industrial designs presented during the event.
  • Preferential and priority processing of urgent precautionary measures (with or without a hearing) related to patents, technological innovations, and industrial designs presented during the event.
  • Resolution within 48 hours:
    • Preliminary proceedings
    • Fact-finding proceedings
    • Precautionary measures without a hearing
  • Resolution in 10 days of applications for precautionary measures with a hearing scheduled, provided there is a preventive brief.
  • Resolution within 24 hours for applications of preventive briefs (for admission)
  • Taking necessary measures to preserve the confidentiality of information that may constitute a trade secret.
  • Adoption and extension of the execution of precautionary measures and/or urgent proceedings related to the metaverse, other types of environments and virtual worlds, and online platforms.

A major novelty taking place in 2024 is the possibility of adopting and extending the execution of precautionary measures and/or urgent proceedings related to infringements arising from content generated by Artificial Intelligence (AI) systems.

The areas in which the Protocol will apply include patents, utility models, industrial designs (Spanish, international, and community models or designs), trademarks (Spanish, international, and EU), trade names, intellectual property, competition defense, unfair competition, illicit advertising, and trade secrets.
